Following are the Terms of Use for Wallestate.com (the "Site") in as plain as English as law allows. Lestategroup.com is a d.b.a. name for the corporate entity Wallestate Group, LLC ("Wallestate Group"). Any person or entity who views or interacts with the Site ("User") or that registers to use the features of the Site ("Members") should read and understand the Terms of Use. Please note that your use of our Site constitutes your agreement to follow and be bound by these terms (the "Agreement").
1. Eligibility
Use of this Site represents and warrants that you are at least 18 years old and that all information that you submit to Wallestate.com is truthful and accurate. This includes, but is not limited to your registration information, profile content, property listing info and item submissions. You agree to update such account information as necessary to keep it accurate. If you misrepresent your age, we may terminate your account at any time without warning, and without any liability. You are solely responsible for maintaining the security and confidentiality of your password and other Member account information. You agree not to permit others to use your password or other Member account information, and you agree to notify Wallestate.com immediately of any unauthorized use of that information. Wallestate.com will not be responsible for any loss or damage arising out of the unauthorized use of your password or other Member account information; and you agree to indemnify and hold harmless Wallestate.com, its officers, directors, agents, employees, subsidiaries, and affiliates for any unauthorized, improper, or illegal use of that information. You, and not Wallestate.com, are solely responsible for all Content or Items published, distributed, or displayed through your account, including without limitation any messages, web log posts, internal or externally embedded "widget" code, or tags, and for your interactions with other Members or users. You further represent and warrant that your use of the Site will not violate any applicable law or regulation.
2. General
Company reserves the right in its sole discretion to edit or delete any information or content appearing on the Site and to remove any goods and services for sale. We may also from time to time change the terms that govern your use of our Site. We may also change our website in general, adding, editing or deleting whatever we please. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed. By becoming a member of the site are opting into our mailings for products, services, and newsletters. Copyright and trade dress, all worldwide rights, titles and interests in and to which are owned by WALLESTATE GROUP protect the Site as a whole. You may download or copy the Contents and other downloadable materials displayed on the Site for your personal use only. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software. The content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a User of any such content or any part of the Site is prohibited.
4. User Content
Wallestate.com enables you to upload, archive, post, publish, e-mail, or otherwise transmit to Wallestate.com ("Upload") web pages, text, code, software, music, sound, photographs, graphics, video, messages, tags, and other information, data, or material (Content). You, and not Wallestate.com, are solely responsible for all Content that you upload to Wallestate.com public archives, blogs, bulletins, classified ads, property listings, investor profiles, search results, categories, groups, or any other part of the Site.
In connection with Content that you Upload to Wallestate.com you represent and warrant that: (1) you own, or have the necessary licenses, consents, permissions, and rights to use and to authorize Wallestate.com to use, all copyright, trademark, patent, trade secret, and other proprietary rights in and to all such Content, in order to permit inclusion and use of the Content as contemplated by the Site and this Agreement; and (2) you have the written consent, release, and/or permission of every person identifiable in the Content to use their name and likeness, in order to permit inclusion and use of the Content as contemplated by the Site and this Agreement.
You retain all of your ownership rights in Content that you upload to Wallestate.com. However, by Uploading the Content to Wallestate.com you hereby grant to L Estate Group a worldwide, non-exclusive, royalty-free, fully paid-up, perpetual, irrevocable, fully sub-licensable (through multiple tiers), and transferable license to copy, distribute, prepare derivative works of, adapt, publicly perform, publicly display, and use the Uploaded Content in connection with the Site and Wallestatecom's business, including without limitation promotion and redistribution of the Site and derivative works thereof, through any media channel and in any media format known now or in the future. In addition, you hereby grant to each Wallestate.com Member or user a non-exclusive license to access the Uploaded Content through the Site, and to reproduce, distribute, prepare derivative works of, adapt, publicly perform, publicly display, and use such Content as permitted through the Site functionality and under this Agreement. These licenses will terminate when you remove the Uploaded
Content from the Site. All tags and comments associated with Content - whether associated by you, the Site, other Members or users, or anyone else- becomes L Estate Group property; but Wallestate.com will grant you a perpetual right to use such tags and comments for personal, noncommercial purposes. 6. Viewing Site Content in using the Site, you may access and be exposed to Content Uploaded by others that are inaccurate, incomplete, indecent, offensive, or otherwise objectionable. Uploaded Content is the sole responsibility of the person who uploaded it. You will not hold Wallestate.com responsible for the actions or inactions of Members or users, including without limitation any Uploaded Content.
